LANCASTER, Calif.– In a major victory for democracy, transparency, and the people of Lancaster, the Superior Court has ruled in favor of the Recall Rex campaign, granting our anti-SLAPP motion and confirming what we’ve said all along: this recall is a protected act of free speech, not a crime.

This legal win exposes the Mayor and his allies’ attempt to silence residents through intimidation and costly litigation. The court’s decision affirms that our right to petition, protest, and hold elected officials accountable is protected by the Constitution and no amount of bullying or lawsuits can change that.

The anti-SLAPP law protects citizens from frivolous lawsuits meant to chill free speech and civic engagement. With the court’s ruling, not only is the city’s lawsuit dismissed, but the recall campaign can restart unencumbered.

“Today’s court victory confirms what we’ve known all along… the lawsuit filed by the City of Lancaster against its own citizens who signed the recall notice was completely meritless. The court clearly recognized that the city likely intended to punish and silence those exercising their First Amendment rights.

This isn’t just a legal victory, it’s a major step forward in taking back our city government from those who use intimidation, voter suppression, and unnecessary tax hikes to maintain their hold on power. It sends a powerful message that our community will never tolerate being bullied or silenced.

I want to sincerely thank Peter and Julia from the ACLU for their steadfast support, along with every courageous resident who stood strong against adversity. Your bravery and determination have set an important precedent, demonstrating our community’s unwavering commitment to justice.

We have momentum now but the fight isn’t over. Together, we’ll keep pushing forward to restore transparency, fairness, and true representation in Lancaster’s city government. Our city deserves leadership that listens to, respects, and genuinely serves the community, not one that tries to silence or punish those who speak out.

Today, we’ve taken a significant step toward reclaiming our democracy. Let’s continue moving forward together, committed to building a city government that truly represents us all.” Johnathon Ervin Statement on the City of Lancaster Suing Its Own Citizens Over the Recall Effort
